هذه اتفاقية بينك وبين مؤسسة حمد الطبية، وهي مؤسسة ومزود رائد في مجال الرعاية الصحية في دولة قطر، تأسست بموجب المرسوم الأميري رقم 11 لسنة 2016، وعنوانها: طريق الريان، ص.ب. 3050 (يشار إليها فيما يلي بـ "مؤسسة حمد الطبية" أو "نحن").

يرجى قراءة "شروط الاستخدام" و"سياسة الخصوصية" قبل استخدام تطبيق سند التابع لمؤسسة حمد الطبية (يشار إليه فيما يلي بـ "تطبيق سند")، بما في ذلك ميزاته وخدماته، وتحديدًا خدمة برنامج صوغة.

بتسجيل دخولك إلى تطبيق سند، فإنك توافق على الالتزام بـ "شروط الاستخدام" و"سياسة الخصوصية" وغيرها من الإرشادات والقواعد والسياسات المعمول بها والتي قد تصدر فيما يتعلق باستخدام تطبيق سند. إذا لم توافق على أي من هذه الشروط والأحكام فلن تتمكن من تسجيل الدخول إلى تطبيق سند ولن تتمكن من استخدامه أو الوصول إليه بشكل كامل بما في ذلك ميزاته وخدماته ذات الصلة.

جميع المحتويات بما في ذلك على سبيل المثال لا الحصر النصوص والصور والرسومات والشعارات وأي مواد أو محتويات اخرى هي ملك لمؤسسة حمد الطبية. يحظر حظراً تاماً استخدام هذه المواد أو نسخها دون إذن كتابي صريح من المؤسسة وتتمتع بالحماية بموجب القوانين والأنظمة المعمول بها. كما يخضع استخدامك لتطبيق سند وأي من ميزاته لأي إرشادات أو قواعد أو سياسات إضافية قد نصدرها من حين لآخر.

1. تطبيق سند:

يتضمن تطبيق سند العديد من الميزات التي يمكن للموظفين المعتمدين الوصول إليها. ويهدف إلى تسهيل التواصل والتفاعل وزيادة الإنتاجية من خلال توفير الخدمات الأساسية في واجهة واحدة سهلة الاستخدام على الهاتف الذكي. وتشمل هذه الميزات:

برنامج صوغة: يُمكّن الموظفين المعتمدين من الوصول إلى برنامج صوغة لامتيازات وخصومات موظفي الرعاية الصحية.

2. استخدام تطبيق سند.

أ. التنزيل. لاستخدام تطبيق سند، يجب أن يكون لديك حساب Apple ID أو حساب Google. يمكنك تنزيل تطبيق سند مجانًا على جهازك المحمول من خلال متجر Apple أو متجر Google Play.

ب. إنشاء حسابك والوصول إليه. يمكنك إنشاء حسابك في تطبيق سند والوصول إليه بتسجيل الدخول باستخدام بيانات اعتماد الموظف لديك. سيُطلب منك بعد ذلك إنشاء رمز PIN آمن لإتمام المعاملات لاحقاً. يُعد استخدامك لتطبيق سند أو الوصول إليه والمعلومات الواردة فيه بمثابة قبولك وإقرارك بشروط الاستخدام هذه.

ج. المعلومات التي تقدمها. أنت مسؤول عن المعلومات التي تقدمها، وتضمن أنها كاملة وصحيحة. تقع على عاتقك مسؤولية تحديث المعلومات التي قدمتها في حال حدوث أي تغيير فيها.

د. أمان وسرية معلومات تسجيل الدخول أنت مسؤول عن الحفاظ عليها. وتُعد جميع التصرفات التي تتم عبر حسابك باستخدام بيانات الدخول الخاصة بك صادرة عنك ما لم يتم إشعار المؤسسة بخلاف ذلك وفقًا للإجراءات المعتمدة. فإذا تم الاشتباه في استخدام حسابك أو الوصول إليه دون إذنك، فأنت توافق على إبلاغنا بذلك فورًا عبر البريد الإلكتروني mobilitymanager@hamad.qa

هـ. حقوق المستخدمين: عند إنشاء حسابك أو الوصول إليه في تطبيق سند، نمنحك حقًا محدودًا وغير حصري وغير قابل للتحويل وقابل للإلغاء لاستخدام تطبيق سند وميزاته وخدماته ذات الصلة والوصول إليها للأغراض المخصصة لها، شريطة التزامك بشروط الاستخدام هذه.

3. الاتصال والتوافر:

يتطلب استخدام تطبيق سند اتصالاً بالإنترنت من مزود خدمة خارجي، ويخضع ذلك للشروط والأحكام والقيود التي قد يفرضها مزود الخدمة. لا نضمن أن يكون استخدامك لتطبيق سند خالياً من أي انقطاع أو تأخير أو خلل في جميع الأوقات. قد يكون تطبيق سند أو أي من ميزاته غير متاح أو معطلاً في بعض الأحيان بسبب مشاكل فنية أو أعمال صيانة أو أي ظروف أخرى غير متوقعة، ولا نتحمل أي مسؤولية عن ذلك. في هذه الحالات، يرجى إبلاغنا بأي صعوبة تواجهها في الاستخدام أو الوصول إلى تطبيق سند عبر البريد الإلكترونيmobilitymanager@hamad.qa لنتمكن من اتخاذ الإجراء المناسب.

4. لا ضمانات أو تعهدات:

يتيح لك تطبيق سند الوصول إلى بعض خدمات الموارد البشرية استنادًا إلى البيانات المتوفرة في الأنظمة المعتمدة لدى مؤسسة حمد الطبية، والتي قد يتم تحديثها أو تعديلها بشكل دوري وفقًا للإجراءات المعمول بها . وتُقدَّم المعلومات والبيانات المتاحة عبر التطبيق لأغراض خدمية وإرشادية، وقد لا تعكس في جميع الأوقات أحدث التحديثات أو الوضع النهائي للبيانات، ولا يُعتد بها وحدها كمرجع نهائي لاتخاذ القرارات الرسمية..

5. قيود إضافية على الاستخدام.

يحظر على مستخدمي تطبيق سند ما يلي:

(أ) التحايل على أي من ميزات الأمان الخاصة بتطبيق سند، أو تعطيلها، أو التلاعب بها بأي شكل من الأشكال، أو أي ميزات تمنع أو تقيد الاستخدام أو نسخ المحتوى المتاح عبر تطبيق سند،

(ب) تقديم معلومات غير صحيحه أو مضللة في بيانات حساب المستخدم،

(ج) السماح لأي طرف ثالث باستخدام تطبيق سند من خلال حسابك،

(د) استخدام تطبيق سند إذا قمنا بتعليق حقك في استخدامه مؤقتًا أو إذا منعناك من الاستمرار في استخدامه،

(هـ) إرسال رسائل غير مرغوب فيها أو رسائل مزعجة أو رسائل متكررة إلينا،

(ز) استخدام التطبيق أو محتواه في أي غرض غير قانوني أو مخالف للأنظمة والقوانين المعمول بها.

(ح) تعديل تطبيق سند أو التدخل فيه أو اختراقه أو تعطيله أو اعتراض الرسائل المتبادلة من خلاله،

(ط) إساءة استخدام تطبيق سند أو اختراقه بالفيروسات أو برامج التجسس أو أي شيء آخر قد يضر بتطبيق سند أو أي مستخدم آخر له،

(ي) استخراج البيانات من تطبيق سند إلا وفقًا لما هو مسموح به بموجب "شروط الاستخدام" هذه،

(ك) نشر أو المساهمة بأي محتوى مسيء أو تهديدي أو فاحش أو مضلل أو كاذب أو مهين، أو محتوى يتضمن أي شكل من أشكال العري أو العنف. في حالة انتهاك أي من القيود المذكورة أعلاه أو جميعها، تحتفظ مؤسسة حمد الطبية بحقها في المطالبة بحقوقها القانونية عبر جميع الوسائل القانونية.

6. الإخلال الجوهري.

مع عدم الإخلال بالحقوق القانونية لمؤسسة حمد الطبية المنصوص عليها هنا، يعد أي إخلال بالحظر الوارد في البند 5 من هذه الاتفاقية إخلالا جوهريا، ويجوز لنا، وفقاً لتقديرنا وجسامة الاخلال، اتخاذ أي من الإجراءات التالية منفردة أو مجتمعة:

(أ) تعليق فوري ومؤقت أو سحب دائم لحق استخدام تطبيق سند،

(ب) توجيه إنذار،

(ج) اتخاذ إجراءات قانونية ضدك، بما في ذلك المطالبة بتعويض عن الأضرار، بما في ذلك التكاليف الإدارية وأتعاب المحاماة المتكبدة نتيجةً لهذا الإخلال،

(د) الكشف عن المعلومات لسلطات إنفاذ القانون، إذا كان ذلك مسموحاً به قانوناً، وإذا رأينا ذلك ضرورياً لاتخاذ الإجراءات القانونية اللازمة،

(هـ) اتخاذ أي إجراء آخر وفقاً لـ"شروط الاستخدام" هذه والقوانين المعمول بها.

7. ملاحظات المستخدمين وردود الاستبيانات.

أنت تقرّ بأن أي ملاحظات أو ردود على الاستبيانات التي قد تكون قدمتها فيما يتعلق بتطبيق سند وميزاته والخدمات ذات الصلة (ويشار إليها مجتمعة بـ"الملاحظات") ليست خاصة أو سرية. كما تقر وتوافق على منحنا ترخيصاً غير حصري وغير قابل للإلغاء ودائماً ومجانياً وغير محدود لاستخدام ملاحظاتك بأي شكل ولأي غرض ومن خلال أي وسيلة أو تقنية معروفة حالياً أو غير معروفة سواء كلياً أو جزئياً وسواء كانت معدلة أو غير معدلة. سنستخدم ملاحظاتك دائماً بما يتوافق مع "شروط الاستخدام" هذه و"سياسة الخصوصية" الخاصة بنا، وأي إرشادات أو قواعد أو سياسات أخرى سارية قد نصدرها من حين لآخر حسب القوانين المعمول بها.

8. حقوق الملكية الفكرية.

أ. ملكية تطبيق سند. تطبيق سند وميزاته من ابتكار مؤسسة حمد الطبية وهي المالكة له.ولا يحق لأي فرد القيام بما يلي: (1) نسخ أو استنساخ تطبيق سند كلياً أو جزئياً، (2) بيع تطبيق سند لأي طرف ثالث كلياً أو جزئياً، (3) تعديل تطبيق سند كلياً أو جزئياً بأي شكل من الأشكال، و/أو (4) محاولة اكتشاف أو الوصول إلى شفرة المصدر لتطبيق سند، كلياً أو جزئياً، ما لم تكن هذه المعلومات قد نشرت أو أتيحت للعموم من قبلنا.

ب. المعلومات المنشورة. المعلومات المنشورة على تطبيق سند هي ملك لمؤسسة حمد الطبية و/أو مُنشئي المحتوى التابعين لها، وهي محمية بموجب القوانين المحلية السارية وقوانين ومعاهدات الملكية الفكرية الدولية ذات الصلة. جميع المعلومات الموجودة على تطبيق سند هي ملكية حصرية لمؤسسة حمد الطبية، وحقوق التأليف والنشر الخاصة بها محفوظة لها. يُعدّ أي إساءة استخدام أو اختلاس لهذه المعلومات انتهاكًا لحقوق الملكية الفكرية لمؤسسة حمد الطبية، ويُخوّل المؤسسة اللجوء إلى القضاء، بما في ذلك المطالبة بالتعويض.

ج. استخدام شعار تطبيق سند: اسم تطبيق سند وشعار التصميم الخاص به ملكٌ لنا. يخضع أي حق في استخدام اسم "مؤسسة حمد الطبية" (بأي تركيبة من الأحرف الصغيرة أو الكبيرة) أو أي شعارات أو أسماء أو غيرها من العلامات المميزة، لشروط الاستخدام هذه والقوانين السارية في دولة قطر. يُعدّ أي إساءة استخدام أو اختلاس لاسم تطبيق سند وشعار التصميم الخاص به انتهاكًا لحقوق الملكية الفكرية لمؤسسة حمد الطبية ويخول المؤسسة اللجوء إلى القضاء، بما في ذلك المطالبة بالتعويض.

9. الإنهاء.

يمكنك إيقاف استخدام تطبيق سند في أي وقت. ويجوز لمؤسسة حمد الطبية، وفقا لتقديرها، إنهاء استخدامك لتطبيق سند في أي وقت، وسيتم إخطارك قبل أسبوعين من تاريخ الإنهاء.

10. تخزين البيانات.

قد يتم تخزين أي بيانات نجمعها منك. وبالتالي، تطبق القوانين السارية في دولة قطر على البيانات المخزنة فيها حسب الحالة.

11. حذف البيانات.

إذا قمت أنت أو قمنا نحن بحذف حساب المستخدم الخاص بك أو سحبتَ حقك في الوصول إلى تطبيق سند فسنحذف أي بيانات مخزنة تتعلق بك وبحسابك وفقاً لسياسة الخصوصية الخاصة بنا. أما أي حقوق متبقية لنا في استخدام هذه البيانات، فستكون وفقًا لأحكام سياسة الخصوصية الخاصة بنا.

12. الأحكام القانونية وتسوية المنازعات.

يقع مقر مؤسسة حمد الطبية في الدوحة/ دولة قطر. باستخدام تطبيق سند وميزاته وخدماته ذات الصلة فإنك توافق على أن قوانين دولة قطر بغض النظر عن قواعد تنازع القوانين وهي التي تحكم "شروط الاستخدام" هذه وأي نزاع ينشأ عنها أو عن استخدامك لتطبيق سند. في حال نشوب أي نزاع يتعلق باستخدامك لتطبيق سند وميزاته وخدماته ذات الصلة فإنك توافق على التواصل معنا أولاً ومحاولة حل هذا النزاع ودياً. أي نزاع بيننا لم يتم حله بشكل ودي يحال نهائياً إلى الاختصاص القضائي الحصري لمحاكم دولة قطر للفصل فيه. بموافقتك على "شروط الاستخدام" هذه، فإنك توافق على الاختصاص القضائي الحصري لمحاكم دولة قطر.

13. التغييرات على تطبيق سند و"شروط الاستخدام":

نعمل باستمرار على تعديل وتحسين تطبيق سند. يجوز لنا إضافة ميزات جديدة، أو تغيير الميزات الحالية أو إزالة الميزات في أي وقت ودون إشعار مسبق. كما يجوز لنا تغيير "شروط الاستخدام" هذه و"سياسة الخصوصية" الخاصة بنا وأي إرشادات أو قواعد أو سياسات أخرى من وقت لآخر وعند قيامنا بذلك سننشر أحدث نسخة من "شروط الاستخدام" و"سياسة الخصوصية" وأي إرشادات أو قواعد أو سياسات أخرى على منصاتنا بما في ذلك تطبيقاتنا على أنظمة iOS وAndroid والويب .في حال اعتبار أي تعديل جوهرياً، سنعلمك بهذه التغييرات عبر البريد الإلكتروني أو إشعار على حسابك في تطبيق سند، إذا لم توافق على الشروط المعدلة، يرجى التوقف عن استخدام تطبيق سند وميزاته وخدماته ذات الصلة.

14. أحكام متفرقة.

أ. المراسلات. أنت توافق على إمكانية إرسال المراسلات إليك إلكترونيًا (مثل البريد الإلكتروني، أو الهاتف، أو أي وسيلة تواصل أخرى) ويجوز لنا إرسال الإشعارات إليك إلكترونياً عبر عنوان البريد الإلكتروني الذي قدمته عند التسجيل في أي من الخدمات التي تقدمها أو تشغلها مؤسسة حمد الطبية أو دولة قطر أو عبر أي وسائل إلكترونية أخرى.

ب. عدم التنازل. لا يفسر عدم ممارستنا لأي من حقوقنا بموجب "شروط الاستخدام" هذه أو القوانين المعمول بها على أنه تنازل عن تلك الحقوق.

ج. قابلية الفصل. وفي حال بطلان أو عدم نفاذ أي بند من بنود "شروط الاستخدام" هذه فإن ذلك لا يؤثر على نفاذ باقي البنود.

د. الإلزام. وتعد "شروط الاستخدام" هذه، و"سياسة الخصوصية"، وأي إرشادات أو قواعد أو سياسات أخرى قد نصدرها وتوافق عليها أنت ملزمة لنا فقط ولا يحق لأي طرف ثالث إنفاذ أي من هذه الأحكام التعاقدية.

بقبولك "شروط الاستخدام" هذه، فإنك تقر وتوافق على أنك قد قرأت وفهمت محتواها بالإضافة إلى "سياسة الخصوصية" الخاصة بنا وغيرها من الإرشادات والقواعد والسياسات المعمول بها.

إذا كانت لديك أي استفسارات بخصوص أي من هذه الشروط والأحكام أو إذا واجهت صعوبة في فهم أي جانب منها يرجى التواصل معنا عبر البريد الإلكتروني mobilitymanager@hamad.qa لنتمكن من توضيحها لك.

Terms of Use

This is an agreement between you and Hamad Medical Corporation, a leading healthcare provider in the State of Qatar established by the Amiri Decree No. 11 of 2016 with address Al Rayyan Road, P.O. Box 3050 (hereinafter referred to as “HMC”, “we”, “our” or “us”).

Please read these “Terms of Use” and our “Privacy Policy” before using the HMC Sanaad Application (hereinafter referred to as “Sanaad App”), including its features and services, namely SOGHA.

By signing in to the Sanaad App, you agree to be bound by these “Terms of Use”, our “Privacy Policy”, and other applicable guidelines, rules and policies, as may be issued in relation to the use of Sanaad App. If you do not accept any of these terms and conditions, then you should not sign in to the Sanaad App and shall not be able to fully use or access the Sanaad App, its features, and related services.

All content, including, but not limited to text, images, graphics, logos, and any other materials or content, is the property of HMC. Such content is protected under applicable laws and regulations. Unauthorized use and/or duplication of this material without express and written permission from HMC is strictly prohibited. Your use of the Sanaad App and any of its features is subject to any additional guidelines, rules, and policies, as may be issued by us from time to time.

Sanaad App. The Sanaad App includes multiple features to be accessed by authorized employees. It is intended to facilitate communication, engagement, and productivity by centralizing important workplace tools into one accessible smartphone interface. These include:

a. SOGHA:Enables authorized employees to access the SOGHA Healthcare Staff Privileges and Discount Program.
Use of Sanaad App.

a. Download. To use the Sanaad App, you must have either an Apple ID or a Google account. You can download the Sanaad App for free on your mobile devices through Apple Store or Google Play Store.

b. Initializing and Accessing Your Account. You can initialize and access your Sanaad App account by signing in using your authorized employee credentials. You are then prompted to create a secure pin for future transactions. Your use or access of Sanaad App and the information therein shall constitute your acceptance and acknowledgement of these “Terms of Use”.

c. Information Provided by You. You are responsible for the information that you provide, which you warrant to be complete and correct. It is your responsibility to update the information that you may have provided in case there is any change thereto.

d. Security and Confidentiality of Login Information. You are responsible for maintaining the security and confidentiality of your login information. All actions performed through your account using your login credentials shall be deemed to have been undertaken you, unless HMC has been notified otherwise in accordance with the approved procedures.. If you have any suspicion that your account has been used or accessed without your authority, you agree to inform us of this immediately by emailing us at mobilitymanager@hamad.qa.

e. Users Rights. Upon initializing or accessing your account with the Sanaad App, we grant you a limited, non-exclusive, non-transferable, and revocable right to use and access the Sanaad App, its features, and related services for their intended purposes, subject to your compliance with these “Terms of Use”.
Connectivity and Availability. The use of the Sanaad App requires an Internet connection from a third-party service provider, which is subject to terms, conditions, and limitations that may be imposed by your service provider. We cannot make any guarantee that your use of the Sanaad App will be free of any interruption, delays, or default at all times. There may be times that the Sanaad App or any of its features is not available or down due to technical issues, maintenance, or any other unforeseen circumstances, for which we do not assume any liability. In such cases, you are free to inform us of any difficulty in the use or access of the Sanaad App that you may encounter at mobilitymanager@hamad.qa, to allow us to take the appropriate action.
No Representation or Warranties. The Sanaad application provides access to certain Human Resources services based on the information available in Hamad Medical Corporation’s authorized systems, which may be updated or amended periodically in accordance with the applicable procedures.

The information and data made available through the Sanaad application are provided for service and informational purposes only. They may not always reflect the most recent updates or the final status of the information and should not be relied upon as the sole or definitive source for making official decisions.
Further Restrictions on Use. Users of the Sanaad App shall be prohibited from: (i) circumventing, disabling, or otherwise manipulating any of the Sanaad App’s security features or any features preventing or restricting the use or copying of the content that is available via the Sanaad App; (ii) providing false or misleading information in the user account details; (iii) allowing any third party to use the Sanaad App under your account; (iv) using the Sanaad App if we have temporarily suspended your right of use or if we have prohibited you to continue using it; (v) sending us junk mail, spam or repeated messages; (vi)Use of the Sanaad application or its content for any unlawful purpose or in breach of any applicable laws or regulations. , (vii) modifying, interfering with, hacking or disrupting the Sanaad App, or intercepting messages exchanged through the Sanaad App; (viii) misusing the Sanaad App or infiltrating it with viruses, trojans, worms, logic bombs or anything else that might harm the Sanaad App or any other user of the Sanaad App; (ix) extracting data from the Sanaad App except as permitted under these “Terms of Use”; and (x) posting or contributing any abusive, threatening, obscene, misleading, untruthful, or offensive content, or content that contains any form of nudity or violence. In case of breach of any or all of the above-mentioned restrictions, HMC reserves the right to claim its legal rights through all legal means.
Material Breach. Without prejudice to HMC’s legal rights as stated herein, any breach of the prohibition under Clause 5 hereof shall constitute a material breach. Depending on the severity of the breach and at our sole discretion , initiating – either individually or in combination of any of the following actions: (i) an immediate, temporary suspension or permanent withdrawal of the right to use the Sanaad App; (ii) issuance of a warning; (iii) initiation of legal proceedings against you, including a claim for compensation for damages, and including reasonable administrative costs and legal fees incurred due to said breach; (iv) disclosure of information to the law enforcement authorities, if and to the extent permitted by law and deemed by us to be necessary in order to pursue legal remedies; and (v) pursuit of any further action in accordance with these “Terms of Use” and applicable laws.
User Feedback and Survey Responses. You acknowledge that any feedback or responses to surveys that you may have provided in connection with the Sanaad App, its features, and related services (together with the “Feedback”) are not private and/or confidential. You further acknowledge and agree that you are granting us worldwide, non-exclusive, irrevocable, perpetual, royalty-free and unlimited license to use your Feedback in any way, for any purpose, and through any medium or technology now known or unknown, whether in whole or in part, and whether as modified or unmodified. We will always use your Feedback in compliance with these “Terms of Use”, our “Privacy Policy”, any other applicable guidelines, rules, and policies as may be issued by us from time to time, and applicable laws.
Intellectual Property Rights.

a. Ownership of the Sanaad App. The Sanaad App and its features are created and owned by HMC. No individual is granted any right to: (i) replicate or copy the Sanaad App, either in whole or in part; (ii) sell the Sanaad App to any third party, either in whole or in part; (iii) modify the Sanaad App, in whole or in part, and/or in any manner whatsoever; and/or (iv) attempt to discover or access the source code of the Sanaad App, in whole or in part, unless such information has been published or released by us into the public domain.

b. Published Information. Information published on the Sanaad App is the property of HMC and/or its content creators and is protected by relevant local governing law and international intellectual property laws and treaties. The entire compilation of the information found on the Sanaad App is the exclusive property of HMC with copyright authorship for said compilation by HMC. Any misuse and/or misappropriation of such information shall be deemed an infringement of HMC’s intellectual property rights and shall be a ground for legal remedies, including but not limited to claim for compensation.

c. Use of the Sanaa App Logo. The Sanaad App tradename and trademark are created and owned by us. Any right to use the name “HMC” (with any combination of lowercase or uppercase letters) or any trademarks, logos, domain names or other characteristic trademarks whatsoever is subject to these “Terms of Use” and applicable Laws in the state of Qatar. Any misuse and/or misappropriation of the Sanaad App’s tradename and trademark shall be deemed an infringement of HMC’s intellectual property rights and shall be a ground for legal remedies, including but not limited to claim for compensation.

Termination. The use of the Sanaad App can be stopped and terminated by you at any time. HMC, upon discretion, may terminate your use of the Sanaad App at any time and you will be notified two weeks prior to the date of termination.
Data Storage. Any data we collect from you may be stored within Qatar. As such, laws of said jurisdiction may apply as regards the data stored therein, as the case may be.
Deletion of Data. If you or we delete your user account or withdraw your right to access the Sanaad App, we will delete any data stored in relation to you and your account with our “Privacy Policy”. Any remaining rights to use any such data that we may have shall be as per the terms of our “Privacy Policy”.
Governing Law and Dispute Resolution. HMC is located in Doha, State of Qatar. By using the Sanaad App, its features and related services, you agree that the laws of Qatar, without regard to principles of conflict laws, will govern these “Terms of Use” and any dispute arising therefrom and/or from your use of the Sanaad App. If any dispute arises in connection with your use of the Sanaad App, its features and related services, you agree to contact us first and attempt to resolve any such dispute amicably. Any dispute between us that has not been resolved amicably shall be finally referred to the exclusive jurisdiction of Qatar courts for resolution. By agreeing to these “Terms of Use”, you consent to said exclusive jurisdiction and venue of Qatar courts.
Changes to Sanaad App and “Terms of Use”. We are constantly modifying and improving the Sanaad App. We may introduce new features, change existing features, or remove features, at any time and without notice. We may also change these “Terms of Use”, our “Privacy Policy”, any other guidelines, rules, and policies from time to time. When we do so, we will post the most current version of any such “Terms of Use”, our “Privacy Policy”, any other guidelines, rules, and policies on platforms that may include our iOS, Android, and Web applications. If any revision is deemed material, we will notify you of the said changes by email or a notification on your user account with the Sanaad App. If you do not agree to the modified terms, you should discontinue your use of the Sanaad App, its features and related services.
Miscellaneous.

a. Communications. You agree that communications can be sent to you by electronic means (such as by email, phone, or other form of text). We may send you notices electronically to the email address that you have provided when you signed up for any services provided or operated by HMC or the State of Qatar, or via other electronic means.

b. Non-Waiver. The failure to enforce any of our rights pursuant to these “Terms of Use” or applicable laws must not be construed as a waiver of such rights.

c. Severability. Should any provision in these “Terms of Use” be or become void or unenforceable, the effectiveness of the remaining provisions will remain unaffected.

d. Binding Nature. These “Terms of Use”, “Privacy Policy”, any other guidelines, rules, and policies that may be issued by us and agreed by yourself shall be binding between us only and no third party shall have the right to enforce any of these contractual provisions.

By accepting these “Terms of Use”, you acknowledge and agree that you have read and understood the contents hereof in conjunction with our “Privacy Policy”, and other applicable guidelines, rules, and policies.
