  • 1.0 POLICY STATEMENT AND PURPOSE:
    • 1.1 This policy is formulated for Hamad Medical Corporation (HMC) health care practitioners to outline the fair dealing process for copying of copyright-protected works for Continuing Professional Development (CPD) activity purposes that can be made in print and/or electronic form.
    • 1.2 The purpose is to ensure that HMC staff who provides and attends accredited CPD activities, shall adhere to the legal and professional guidelines of HMC as Accredited CPD Provider by the Ministry of Public of Health (MOPH) Department of Healthcare Professions-Accreditation Section (DHP-AS).
  • 2.0    DEFINITIONS:
    • 2.1 Department of Healthcare Professions (DHP) at Ministry of Public Health (MOPH) – The sole authority responsible for the regulation of healthcare practitioners working in the State of Qatar.

    • 2.2 Department of Healthcare Professions-Accreditation Section (DHP-AS) – Is one of the three main sections in the Department of Healthcare Professions (DHP) concerned with accrediting medical education activities and those which are related to different health specialties and organizing the participation of health practitioners in CPD program/activity in Qatar.

    • 2.3 Accredited CPD Provider – An organization that has been reviewed and approved by the DHP-AS based on their ability to demonstrate adherence to established accreditation standards in areas of educational development, governance, organizational infrastructure and administrative operations to ensure quality and consistency.

    • 2.4 Continuing Professional Development (CPD) – Is a holistic approach towards the enhancement of personal skills and proficiency throughout a professional’s career. It consists of educational activities that focus on discipline-specific knowledge and skills but embraces learning across a wide range of content areas and competencies (for example communication skills, professionalism, leadership and management skills, healthcare quality management, evidence based practice and clinical guidelines, information technology, collaboration and teamwork skills and quality improvement) needed to deliver high-quality healthcare. The CPD activities are categorized as follows:
      • 2.4.1 Category 1: Accredited Group Learning Activities.
      • 2.4.2 Category 2: Self-Directed Learning Activities.
      • 2.4.3 Category 3: Assessment Activities.
    • 2.5 Scientific Planning Committee (SPC) – A group of people who plan, organize and develop sponsored, funded or non-sponsored CPD events/activity and ensuring DHP-AS accreditation standards are adhered to. Other term for them is CPD Organizer.

    • 2.6 Academic Institution – An educational institute (e.g., college, university) which grants undergraduate and postgraduate degrees, dedicated to education and research, accredited and governed by the State of Qatar laws.

    • 2.7 Academic Health System – Also referred to as Academic Medical Center or major teaching hospital) integrated with a medical school and based on three interconnected pillars: clinical care, research and education.

    • 2.8 Fair Dealing – Is a user’s right in copyright law permitting use of, or “dealing” with, a copyright protected work without permission or payment of copyright royalties.

    • 2.9 Excerpt – Is a short piece, passage or quotation of writing (e.g., book, story, article, speech) or music which is taken, selected, or copied / extracted from a larger work.

    • 2.10 Copyright – The exclusive legal right to reproduce, publish, sell, or distribute the matter and form of something (such as a literary, musical, or artistic work).

    • 2.11 License Agreement – Is a contract between a licensor and licensee in which the licensee gains access to and permission to use the licensor's intellectual property.
  • 3.0 RESPONSIBILITIES:
    • 3.1 Director of Medical Education Department / CPD Chair: Responsible for approving this policy.

    • 3.2 HMC CPD Program Steering Committee: Responsible for developing, revising, updating and disseminating this policy.

    • 3.3 Department CPD Lead: Responsible for monitoring and educating this policy.

    • 3.4 Scientific Planning Committee (SPC) or CPD organizer: Responsible for implementing and monitoring the compliance of this policy.

    • 3.5 All Speakers, Authors, Educators, and HMC Healthcare Practitioners: Responsible to be aware and comply with this policy.
  • 4.0 PROCEDURE/PROCESS:
    • 4.1 The Scientific Planning Committee (SPC), speakers, authors, and educators, who directly contribute in the development and delivery of CPD and must be aware on what to qualify for fair dealing.
    • 4.2 Two conditions must be present for the purpose of fair dealing:
      • 4.2.1 First condition: the purpose for research, private study, criticism, review, news reporting and education.
      • 4.2.2 Second condition must be “fair.”: The following factors shall be used to determine whether a dealing is fair:
        • 4.2.2.1 The purpose of proposed copying.
        • 4.2.2.2 The number of copies.
        • 4.2.2.3 The amount or proportion of work.
        • 4.2.2.4 The effect of copying.
    • 4.3 The copying of copyright-protected works for Continuing Professional Development (CPD) activity purposes should:
      • 4.3.1 Mention the source and name of the work’s author if available in the following:
        • 4.3.1.1 News reporting
        • 4.3.1.2 Reviews
        • 4.3.1.3 Criticism (within acceptable practice)
        • 4.3.1.4 Illustrations for teaching
        • 4.3.1.5 Sound or visual recordings
        • 4.3.1.6 Academic presentations
      • 4.3.2 Be declared to CPD participants using the Disclosure Statement Slide in policy OP 4043, Continuing Professional Development Activities (CPD) Conflict of Interest Declaration and Management, Appendix 3) for CPD activity with no plagiarism or copyright infringement.
      • 4.3.3 Be acknowledged in any of the following method:
        • 4.3.3.1 Writing the references by using the appropriate referencing, such as but not limited to:
          • 4.3.3.1.1 American Psychological Association (APA) Referencing
          • 4.3.3.1.2 American Medical Association (AMA) Referencing
          • 4.3.3.1.3 Harvard Referencing
          • 4.3.3.1.4 Vancouver Referencing
        • 4.3.3.2 Bibliography
        • 4.3.3.3 In-text citation
    • 4.4 Course director/planner, speakers, authors, educators, may reproduce excerpts from a copyright-protected work for the purpose of CPD educational activities without paying a royalty/fee to the author.

    • 4.5 The excerpt should be an extract which is 10% or less of a work, or no more than:
      • 4.5.1 One chapter from a book.
      • 4.5.2 A single article from a periodical (journal, magazine, review, publication).
      • 4.5.3 An artistic work (painting, print, photograph, diagram, map, chart and plan) from the entire work.
      • 4.5.4 An article or page from the newspaper.
    • 4.6 A copy of the excerpt may be provided to each learner registered in the CPD activity.

    • 4.7 Copying, distribution restrictions or usage of others’ presentation shall:
      • 4.7.1 Adhere to the license and agreement of HMC library for all E-resources.
      • 4.7.2 Have permission and acknowledgment of the main author before presenting.
      • 4.7.3 Comply with HMC legal and professional guidelines, failure to do so, disciplinary action has to be taken.
      • 4.7.4 Be observed by academic institution/academic health system in all educational activities.
    • 4.8 Works available on the Internet:
      • 4.8.1 If the person selecting, copying and or extracting the works from the internet, he/she must mention the source using the Universal Resource Locator (URL) (e.g., https://www.hamad.qa).
      • 4.8.2 Usage of screen images, videos, tables, graphics and other people’s presentation should abide with the rules and regulations set by the iStock Content License Agreement, Creative Commons (CC) license and any web browser or webpage.
  • 5.0 DOCUMENTATION:
    • 5.1 All sources of copyrighted educational materials used in the CPD activity shall be documented in the references, or bibliography and/or intext citation in the presentations, hand-outs, e-learning resources, video and audio including the URL and/or web browser or webpage.
